Terms of Service
Klinch LLC
Effective Date: May 16, 2026
1. Acceptance of Terms
By downloading, installing, or using the Klinch desktop application or website at tryklinch.com ("Klinch"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use Klinch. These Terms constitute a legally binding agreement between you and Klinch LLC, an Illinois limited liability company ("Klinch," "we," "us," or "our").
2. Eligibility
You must be at least 18 years old to use Klinch. By creating an account, you represent and warrant that you are 18 or older. We reserve the right to terminate accounts of users we determine to be under 18.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials. You may not share your account with anyone else. You are responsible for all activity that occurs under your account. Notify us immediately at hello@tryklinch.com if you believe your account has been compromised.
4. Subscription, Billing, and Refunds
4.1 Plans
Klinch offers a free trial and paid subscription plans as described at tryklinch.com. Paid plans are billed in advance on a monthly basis via Stripe.
4.2 Free Trial
The free trial includes 3 interview sessions and is valid for 7 days from account creation. No credit card is required to start a trial.
4.3 Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends.
4.4 Refunds
Refunds are handled on a case-by-case basis. To request a refund, contact hello@tryklinch.com. We are not obligated to provide refunds but will consider requests reasonably and in good faith.
4.5 5-Interview Packs
One-time 5-interview packs are valid for 30 days from the date of purchase. Unused sessions expire at the end of the 30-day period and are non-refundable.
5. Acceptable Use
You agree to use Klinch only for lawful purposes and in accordance with these Terms. You agree not to:
- Use Klinch during employer-administered skills assessments, coding tests, take-home assignments, or any evaluation where AI assistance is prohibited
- Share your account credentials with any other person
- Attempt to reverse engineer, decompile, or extract Klinch's source code, AI models, or system prompts
- Circumvent or attempt to circumvent session caps, usage limits, or subscription restrictions
- Use Klinch to misrepresent qualifications, experience, or skills you do not possess in a fraudulent manner
- Resell, sublicense, or otherwise commercialize access to Klinch
- Use Klinch to scrape, harvest, or collect data from third-party platforms in violation of their terms
- Use Klinch in any way that violates applicable local, state, national, or international law
We reserve the right to suspend or terminate your account at our sole discretion if we determine you have violated these Terms.
6. One-Sided Audio Capture and Recording Consent
Klinch captures audio from your microphone only. We do not capture, record, or transmit audio from other participants on your call.
You are solely responsible for complying with all applicable recording and wiretapping laws in your jurisdiction. Some jurisdictions require the consent of all parties before any recording occurs. While Klinch does not record other parties, certain jurisdictions may still impose obligations on you based on your use of the application.
By using Klinch Ear, you represent that your use complies with all applicable laws. Klinch LLC assumes no liability for your failure to comply with recording laws in your jurisdiction. You agree to indemnify and hold Klinch LLC harmless from any claims, damages, or penalties arising from your non-compliance.
7. Community Question Library
By using Klinch Ear, you agree that questions inferred from your session may be contributed anonymously to a shared question library. This contribution is automatic and cannot be opted out of. All contributed questions are processed by AI to remove personally identifiable information before storage. No user IDs or identifying information are stored alongside community questions.
8. Intellectual Property
Klinch and all content, features, and functionality of the application — including but not limited to software, text, graphics, logos, and AI-generated outputs — are the property of Klinch LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of Klinch without our express written permission.
AI-generated coaching feedback, resume suggestions, and interview guidance produced by Klinch are provided for your personal use only. You retain ownership of the resume content and other materials you upload.
9. Disclaimer of Warranties
Klinch is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that Klinch will be uninterrupted, error-free, or that any particular result will be achieved from using it. We make no guarantee that using Klinch will result in job offers, interviews, or any specific career outcome.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Klinch LLC's total liability to you for any claims arising out of or related to these Terms or your use of Klinch shall not exceed the total amount you paid to Klinch in the twelve (12) months preceding the claim.
In no event shall Klinch LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or loss of opportunity, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Klinch LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of Klinch, your violation of these Terms, or your violation of any applicable law.
12. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Klinch shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Illinois. Each party shall bear its own costs.
You waive any right to participate in a class action lawsuit or class-wide arbitration against Klinch LLC.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law provisions.
14. Changes to These Terms
We may update these Terms at any time. If we make material changes, we will notify you by email or via an in-app notice. Continued use of Klinch after changes constitutes your acceptance of the updated Terms.
15. Termination
We reserve the right to suspend or terminate your account and access to Klinch at our sole discretion, with or without notice, for any violation of these Terms or for any other reason we deem appropriate. Upon termination, your right to use Klinch ceases immediately.
